visti gli articoli 1 e 8 della legge 29 dicembre 1990, n. 428, recante disposizioni per l’adempimento di obblighi derivanti dall’appartenenza dell’Italia all’Unione Europea;
visto il decreto legislativo 9 novembre 2007, n. 206, di attuazione della direttiva n. 2005/36/CE del 7 settembre 2005, relativa al riconoscimento delle qualifiche professionali;
visto il decreto del Presidente della Repubblica 5 giugno 2001, n. 328 e successive integrazioni, contenente “Modifiche ed integrazioni della disciplina dei requisiti per l’ammissione all’esame di Stato e delle relative prove per l’esercizio di talune professioni, nonché della disciplina dei relativi “ordinamenti”;
visto il decreto ministeriale 3 dicembre 2014, n. 200, che adotta il regolamento in materia di misure compensative per l’esercizio della professione di ingegnere;
vista l’istanza del dott. Giacomo Napolitano, nato a Latina (Italia) il 28 ottobre 1990, cittadino italiano, diretta ad ottenere, ai sensi dell’art. 16 del decreto legislativo 9 novembre 2007, n. 206, il riconoscimento del titolo professionale di Chartered Engineer, conseguito nel Regno Unito, ai fini dell’iscrizione nell’albo degli ingegneri – sezione A, settore industriale, e dell’esercizio in Italia della relativa professione;
considerato che il richiedente ha conseguito presso l’Università degli Studi di Genova la laurea in ingegneria navale in data 13 dicembre 2012 e la laurea magistrale in ingegneria navale in data 31 marzo 2016, a compimento di un ciclo di studi di durata quinquennale;
preso atto che il dott. Napolitano è iscritto in qualità di Chartered Engineer alla Royal Institution of Naval Architets dal 17 aprile 2020 al n. 673994, avendo completato il percorso richiesto dalla suddetta Istitution inglese, come da quest’ultima attestato nella nota del 26 ottobre 2020;
rilevato che l’istante ha comprovato lo svolgimento di attività professionale nel Regno Unito da ottobre 2015 a settembre 2020;
visto il parere espresso dal rappresentante del Consiglio nazionale di categoria, pervenuto in data 17 novembre 2020;
considerato che, date le differenze tra la formazione professionale richiesta in Italia per l’esercizio della professione di ingegnere iscritto nell’albo alla sezione A, settore industriale, e quella di cui è in possesso l’istante, risulta opportuno richiedere una misura compensativa;
visto l’art. 22, comma 1, del decreto legislativo n. 206/2007, sopra indicato,
decreta
al dott. Giacomo Napolitano, nato a Latina (Italia) il 28 ottobre 1990, cittadino italiano, è riconosciuto il titolo professionale di Chartered Engineer, conseguito nel Regno Unito, ai fini dell’iscrizione nell’albo degli ingegneri – sezione A, settore industriale, e dell’esercizio in Italia della relativa professione.
Detto riconoscimento è subordinato al superamento di una prova attitudinale sulla materia di seguito indicata, oppure, a scelta del richiedente, allo svolgimento di un tirocinio di adattamento sulla stessa materia per un periodo di 4 (quattro) mesi.
La prova attitudinale, ove oggetto di scelta da parte del candidato, verterà sulla seguente materia:
- Impianti chimici (prova orale)
La prova attitudinale, volta ad accertare la conoscenza della materia indicata nel testo del decreto, si compone di un esame orale da svolgersi in lingua italiana. L’esame orale consiste nella discussione di brevi questioni tecniche vertenti la materia sopra indicata e, altresì, sulle conoscenze di deontologia professionale del candidato.
Il candidato, per essere ammesso a sostenere la prova attitudinale, dovrà presentare domanda al Consiglio nazionale, allegando copia autentica del presente decreto. La commissione, istituita presso il Consiglio nazionale, si riunisce su convocazione del presidente, per lo svolgimento delle prove di esame, fissandone il calendario. Della convocazione della commissione e del calendario fissato per la prova è data immediata notizia all’interessato, al recapito da questo indicato nella domanda.
La commissione rilascia all’interessato certificazione dell’avvenuto superamento dell’esame, al fine dell’iscrizione nell’albo degli ingegneri, sezione A, settore industriale.
Il tirocinio di adattamento, ove oggetto di scelta del richiedente, è diretto ad ampliare e approfondire le conoscenze di base, specialistiche e professionali sulla materia sopra riportata. Il richiedente presenterà domanda al Consiglio nazionale, allegando copia conforme del presente decreto, nonché la dichiarazione di disponibilità dell’ingegnere tutor. Detto tirocinio si svolgerà presso un ingegnere, scelto dall’istante tra i professionisti che esercitino nel luogo di residenza del richiedente e che abbiano un’anzianità d’iscrizione all’albo professionale di almeno otto anni. Il Consiglio nazionale vigilerà sull’effettivo svolgimento del tirocinio, a mezzo del presidente dell’Ordine provinciale.

Having regard to articles 1 and 8 of Law no. 428 of 29 December 1990, containing provisions for the fulfilment of obligations deriving from Italy’s membership of the European Union;
having regard to Legislative Decree no. 206 of 9 November 2007, implementing Directive no. 2005/36/EC of 7 September 2005 on the recognition of professional qualifications;
having regard to Presidential Decree no. 328 of 5 June 2001 and subsequent additions, containing “Amendments and additions to the regulations governing the requirements for admission to the State examination and the relative tests for the exercise of certain professions, as well as the regulations governing the relative “systems”;
having regard to Ministerial Decree no. 200 of 3 December 2014, adopting the regulation on compensatory measures for the exercise of the profession of engineer;
having regard to the request of Dr. Giacomo Napolitano, born in Latina (Italy) on 28 October 1990, an Italian citizen, to obtain, pursuant to art. 16 of Legislative Decree no. 206 of 9 November 2007, the recognition of the professional title of Chartered Engineer, obtained in the United Kingdom, for the purpose of registration in the Register of Engineers – section A, industrial sector, and the exercise in Italy of the relevant profession;
considering that the applicant obtained a degree in Naval Engineering from the University of Genoa on 13 December 2012 and a Master’s degree in Naval Engineering on 31 March 2016, upon completion of a five-year course of study;
having taken note that Dr Napolitano is enrolled as Chartered Engineer at the Royal Institution of Naval Architects from 17 April 2020 to no. 673994, having completed the course required by the aforementioned English Institution, as certified by the latter in its note of 26 October 2020;
noted that the applicant has provided evidence of his professional activity in the United Kingdom from October 2015 to September 2020;
having regard to the opinion expressed by the representative of the National Trade Council, received on 17 November 2020;
considering that, given the differences between the professional training required in Italy for the exercise of the profession of engineer registered in section A, industrial sector, and that in the applicant’s possession, it is appropriate to request a compensatory measure;
having regard to Article 22, paragraph 1, of Legislative Decree no. 206/2007, mentioned above,

Dr. Giacomo Napolitano, born in Latina (Italy) on 28 October 1990, an Italian citizen, is awarded the professional title of Chartered Engineer, obtained in the United Kingdom, for the purpose of enrolment in the Register of Engineers – section A, industrial sector, and the exercise of the relevant profession in Italy.
This recognition is subject to passing an aptitude test on the subject indicated below, or, at the applicant’s choice, an adaptation period of 4 (four) months.
The aptitude test, if chosen by the applicant, shall cover the following subject matter:

The aptitude test, aimed at ascertaining knowledge of the subject indicated in the text of the decree, consists of an oral examination to be held in Italian. The oral examination consists of the discussion of brief technical questions concerning the subject indicated above and, also, the candidate’s knowledge of professional ethics.
In order to be admitted to the aptitude test, the candidate must submit an application to the National Council, enclosing a certified copy of this decree. The committee, set up at the National Council, shall meet on convocation of the President, for the conduct of the examinations, fixing the calendar. The person concerned shall be informed immediately of the convening of the committee and the calendar set for the examination, at the address indicated in the application.
The committee shall issue the interested party with a certificate of passing the examination in order to be entered in the Register of Engineers, section A, industrial sector.
The adaptation traineeship, if chosen by the applicant, is intended to broaden and deepen the basic, specialist and professional knowledge of the above mentioned subject. The applicant shall apply to the National Council, enclosing a certified copy of this decree, as well as the declaration of availability of the mentor engineer. This internship will be carried out with an engineer, chosen by the applicant from among the professionals who practice in the applicant’s place of residence and who have at least eight years’ seniority in the professional register. The National Council shall ensure that the traineeship is carried out effectively, through the President of the Provincial Order.
